Terms and Conditions of Use

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you

(“User,” “you”) and MeetMeOnBoard, a service operated by Martindale Travel & Tours LLC d/b/a Cruise Planners (“Company,” “we,” “us,” or “our”). By accessing, downloading, or using the MeetMeOnBoard mobile application or website (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. Eligibility and Age Restriction

1.1 The Service is intended solely for individuals eighteen (18) years of age or older. By using the Service, you represent and warrant that you are at least 18 years old.

1.2 We reserve the right to employ age verification measures, including third-party age verification tools. Any misrepresentation of age constitutes a material breach of these Terms and will result in immediate account termination and data deletion in accordance with applicable law.

2. Account Registration and Security

2.1 To access certain features of the Service, you must create an account by providing accurate, current, and complete information. You agree to update this information to maintain its accuracy.

2.2 You are solely responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is your responsibility. You agree to notify us immediately at support@meetmeonboard.com of any unauthorized use.

3. User Conduct and Prohibited Activities

3.1 You agree to use the Service only for lawful purposes and in a manner consistent with these Terms and applicable law.

3.2 You agree not to:

(a) Use the Service in any manner that violates any local, state, national, or international law;

(b) Post, upload, or distribute any content that is obscene, pornographic, defamatory, offensive, threatening, discriminatory, or otherwise inappropriate;

(c) Harass, stalk, or threaten other users;

(d) Share or solicit sexually explicit material, including in private messages;

(e) Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

(f) Use the Service to promote or conduct commercial activity without prior written consent;

(g) Attempt to gain unauthorized access to the Service, servers, or systems;

(h) Interfere with or disrupt the integrity or performance of the Service.

4. User-Generated Content

4.1 Users retain ownership of the content they submit to the platform. By posting content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, adapt, publish, distribute, and display such content in connection with the operation of the Service.

4.2 You represent and warrant that:

(a) You own or have all necessary rights to the content you post;

(b) Your content does not violate any applicable law or the rights of any third party.

4.3 We reserve the right, but not the obligation, to remove or modify any user content that we, in our sole discretion, determine violates these Terms.

5. Booking and Financial Disclaimer

5.1 MeetMeOnBoard does not process bookings, reservations, or financial transactions.

5.2 All cruise bookings are handled exclusively through third-party providers (e.g., Cruise Planners). The Company disclaims all responsibility for the accuracy, timeliness, legality, or completeness of any transaction conducted with such third parties.

6. Privacy and Data Protection

6.1 Our collection, use, and disclosure of personal data are governed by our Privacy Policy, which complies with applicable data protection laws including the California Consumer Privacy Act (CCPA), California Privacy Rights Act (CPRA), General Data Protection Regulation (GDPR), and the UK Data Protection Act 2018.

6.2 You agree to the transfer and storage of your personal data on secure servers located in the

United States. Users who do not consent to such transfer should not use the Service.

7. Intellectual Property

7.1 All content and materials on the Service, excluding user-generated content, are the intellectual property of the Company or its licensors.

7.2 You may not reproduce, distribute, modify, or create derivative works from any portion of the Service without prior written permission.

8. Suspension and Termination

8.1 We may suspend or terminate your account or access to the Service at any time, with or without cause, and without prior notice.

8.2 Reasons for termination include but are not limited to:

• Violation of these Terms

•Illegal or fraudulent activity

•Harassment or abuse of other users

9. Disclaimers and Limitation of Liability

9.1 THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A

PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

10.2 Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.

11. Modifications to Terms

11.1 We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service.

11.2 Continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes.
